BEFORE: BROWN, KENNEDY and MARTIN, Circuit Judges Order Upon consideration of defendant-appellant's motions requesting a stay pending appeal and requesting the Court to expedite review of his appeal and the response submitted in relation thereto, It appearing that the District Court judgment granting the plaintiff's motion for partial summary judgment does not contain an express direction for entry of a final judgment nor does it contain a determination that there is no just reason for delay of an appeal from the judgment as provided by Rule 54(b), Federal Rules of Civil Procedure, it is determined that this Court lacks jurisdiction to entertain this appeal under 28 U.S.C. Ãâ€Å¡Ãƒ‚§ 1291. William B. Tanner Co. v. United States, 575 F.2d 101 (6th Cir. 1978); Kirtland v. J. Ray McDermott & Co., 568 F.2d 1166 (6th Cir. 1978); Moody v. Kapica, 548 F.2d 133 (6th Cir. 1976). Moreover, there does not exist in the record a certification under 28 U.S.C. Ãâ€Å¡Ãƒ‚§ 1292(b) which would allow the Court to entertain the appeal from an interlocutory judgment. Concluding that oral argument is not necessary in this appeal, Rule 34, Federal Rules of Appellate Procedure, It is, accordingly, ORDERED that the motions be and hereby are denied; and, it is also ORDERED that this appeal be and hereby is dismissed for lack of jurisdiction pursuant to Rule 9(d)1, Rules of the Sixth Circuit.
